According to reports, Los Angeles Police Department (LAPD) officers were responding to a disturbance involving possible gunfire at a Halloween gathering in Sherman Oaks. Authorities said approximately 300 people attended the party, which prompted a police response around 10:30 p.m.

While traveling toward the location, an LAPD patrol vehicle struck a 32-year-old woman near a marked pedestrian crosswalk in Valley Glen. Police confirmed that the cruiser had its emergency lights and siren activated when the collision occurred.

Both officers remained at the scene. The woman was pronounced dead following the crash.

California Laws and Wrongful Death Claims Involving Police Vehicles

The LAPD cruiser crash in Valley Glen raises questions about emergency vehicle operations, pedestrian safety, and potential liability when a fatal collision involves a government vehicle.

California law provides several important considerations:

  • Emergency vehicle operations: California Vehicle Code § 21055 provides certain traffic-law exemptions for authorized emergency vehicles responding to emergencies when statutory conditions are satisfied, including applicable warning requirements.
  • Duty to drive safely: California Vehicle Code § 21056 states that emergency vehicle exemptions do not eliminate the driver’s duty to operate with due regard for public safety.
  • Wrongful death claims: California Code of Civil Procedure § 377.60 identifies eligible surviving family members who may bring wrongful death actions. Recoverable damages may include funeral expenses, lost financial support, and loss of companionship.
  • Government claim deadlines: Under California Government Code § 911.2, qualifying wrongful death claims against California public entities generally must be presented within 6 months. Exceptions and additional procedural requirements may apply.

The activation of emergency lights and sirens does not automatically resolve questions of liability. Investigators may examine vehicle speed, roadway conditions, visibility, witness statements, and available surveillance footage.

Whether a wrongful death claim is viable depends on the evidence and applicable government liability rules.
