Sacramento, California — A Highway 50 DUI crash involving a suspected impaired driver killed a road construction worker early Monday morning in Sacramento. Authorities are investigating the fatal collision, which occurred inside a marked construction zone near the Stockton Boulevard overpass.
Road Worker Killed on Highway 50 in Sacramento
The crash occurred around 12:39 a.m. on August 10 along eastbound Highway 50 near Stockton Boulevard. A construction crew was working in a closed lane and shoulder when a Honda entered the coned-off area and struck a construction vehicle being used near the work zone.
Investigators said the Honda then struck a worker, identified as 45-year-old Onias Avila De Rodriguez of Modesto. He fell from the elevated freeway onto Stockton Boulevard and was pronounced dead at the scene.
Authorities said the driver continued from the scene and was involved in another collision before being apprehended. CHP investigators suspect alcohol was a factor in the Highway 50 DUI crash.
When a Suspected DUI Crash Results in a Wrongful Death
Beyond any criminal investigation, a fatal suspected DUI collision may also give rise to separate civil liability. California Code of Civil Procedure Section 377.60 allows certain surviving family members or a decedent’s personal representative to pursue a wrongful death claim when a death results from another person’s wrongful act or negligence.
Depending on the circumstances, compensation may address losses such as:
- Funeral and burial expenses
- Lost financial support and household contributions
- Loss of companionship and support
- Other damages allowed under California law
California generally provides two years to bring an action for death caused by another person’s wrongful act or neglect, although exceptions may affect the deadline.
