Fresno County, California ā A Highway 41 crash near Elkhorn Avenue left one driver dead and another injured after two pickup trucks collided early Wednesday morning. California Highway Patrol investigators are examining whether alcohol contributed to the wrong-way collision.
Wrong-Way Crash Reported on Highway 41 Near Riverdale
The collision occurred shortly before 1:30 a.m. on Highway 41 at Elkhorn Avenue, several miles north of Riverdale. According to the California Highway Patrol, a Chevrolet Silverado was reportedly traveling in the wrong direction when it collided with a Ford F-150.
Both trucks left the roadway and came to rest on the shoulder. Emergency crews airlifted both drivers to Community Regional Medical Center for treatment.
The Silverado driver later died from his injuries. Authorities had not publicly identified him at the time of the report.
CHP said physical evidence indicated alcohol may have been a factor, although toxicology results were still pending. The Highway 41 crash remains under investigation. The road that was temporarily shut down after the collision has now reopened.
California Legal Considerations After a Fatal Highway Collision
When a serious collision results in injury or death, a separate civil investigation may examine negligence, impairment, roadway conditions, and other contributing factors. A criminal investigation or toxicology finding does not automatically determine civil liability.
California accident claims may involve:
- Wrongful death claims: Certain surviving family members may pursue a claim when a death results from another person’s wrongful act or negligence under California Code of Civil Procedure § 377.60.
- Personal injury damages: An injured person may seek compensation for qualifying losses, including medical expenses, lost earnings, and noneconomic harm.
- Evidence preservation: Police reports, toxicology results, vehicle damage, roadway evidence, witness statements, and medical records may help establish the cause of the collision.
- Filing deadlines: California generally provides two years to bring an action for injury or death caused by another person’s wrongful act or neglect, although exceptions may apply.
Families affected by a fatal crash may benefit from reviewing the available evidence before deciding whether a civil claim is appropriate.
