California Law Overview on Serious Accident Claims

A serious car crash in Sacramento County may prompt an investigation that examines more than the actions of one driver. Investigators and insurers can review speed, right-of-way, vehicle movement, witness accounts, roadway evidence, and whether another motorist contributed to the sequence of events.

California Vehicle Code Section 22350 requires motorists to travel at a speed that is reasonable and prudent for existing traffic and roadway conditions.

For injured passengers and families, relevant issues may include:

  • Whether another driver’s actions contributed to the collision
  • Available auto insurance coverage
  • Evidence showing how the crash occurred
  • Medical expenses, lost income, and other accident-related losses
  • Potential wrongful death or personal injury claims, when supported by the evidence

California generally provides two years to bring an action for injury or wrongful death based on another party’s wrongful act or negligence, although exceptions may apply.
